• Loss of profits, revenue, data, or goodwill.
• Cost of procurement of substitute goods or services.
• Damages arising from your use of or inability to use the Site, its Content, or its tools.
• Damages arising from any errors, inaccuracies, omissions, or outdated information in the Content or tools.
• Damages arising from any decisions made, actions taken, or actions not taken based on information provided on or through the Site.

THIS LIMITATION OF LIABILITY APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, INCLUDING BUT NOT LIMITED TO CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), WARRANTY, OR ANY OTHER LEGAL OR EQUITABLE THEORY, AND REGARDLESS OF WHETHER THE DD FORM 214 LIFE PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF THE DD FORM 214 LIFE PARTIES TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO DD FORM 214 LIFE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100.00), WHICHEVER IS LESS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, THE LIABILITY OF THE DD FORM 214 LIFE PARTIES SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

You agree to indemnify, defend, and hold harmless the DD Form 214 Life Parties from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:

• Your use of or access to the Site.
• Your violation of these Terms or any applicable law or regulation.
• Your reliance on any Content, tools, or information provided on or through the Site.
• Any decisions made or actions taken by you based on the Site's Content.
• Any claim by a third party arising from your use of the Site.

This indemnification obligation shall survive the termination of these Terms and your use of the Site.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and DD Form 214 Life agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your use thereof (collectively, "Disputes") shall first be attempted to be resolved through informal negotiation. Either party may initiate informal negotiations by providing written notice to the other party describing the nature and basis of the Dispute and the relief sought.

If a Dispute cannot be resolved through informal negotiation within thirty (30) days after the initial notice, either party may initiate binding arbitration. Any arbitration shall be administered under the rules of the American Arbitration Association ("AAA") then in effect. The arbitration shall be conducted by a single arbitrator, selected in accordance with AAA rules, in the English language, and shall take place in the United States.

The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs and attorneys' fees in the arbitration, unless the arbitrator determines that a party's claims or defenses were frivolous or brought in bad faith.

YOU AND DD FORM 214 LIFE AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR DD FORM 214 LIFE WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY.

No arbitration or proceeding may be combined with another without the prior written consent of all parties involved. If this class action waiver is found to be unenforceable, then the entirety of the arbitration provision in Section 8 shall be null and void.

Certain features of the Site, including DD Form 214 Life Pro subscription services and AI-powered tools, require you to create a user account. When you create an account, we collect your email address and authentication credentials through our third-party authentication provider (Supabase). When you subscribe to a paid plan, your payment information is collected and processed directly by Stripe, Inc. — we do not store your credit card numbers, bank account details, or other payment card data on our servers.

Free tools on the Site, including the DD-214 Decoder, MOS Translator, VA Disability Calculator, and other calculators, continue to process data entirely within your browser on your local device. No document data or personal information from these free tools is transmitted to our servers.

PLEASE READ THIS SECTION CAREFULLY. IT DESCRIBES HOW YOUR DATA IS PROCESSED WHEN YOU USE AI-POWERED FEATURES.

DD Form 214 Life Pro includes AI-powered features such as AI Resume Review, AI Cover Letter Generator, AI Claim Analyzer, AI Transition Advisor Chat, and AI Job Search (collectively, "AI Features"). These AI Features are powered by third-party artificial intelligence services provided by Anthropic, PBC ("Anthropic") through their Claude API. By using any AI Feature, you acknowledge and agree to the following:

• Data Transmission to Third Parties: When you use an AI Feature, the text you submit (including resume content, cover letter inputs, claim descriptions, chat messages, and job search queries) is transmitted to Anthropic's servers for processing. This data leaves your browser and our servers and is processed by Anthropic in accordance with Anthropic's Commercial Terms of Service and Anthropic's Privacy Policy.
• No Training on Your Data: Under Anthropic's Commercial API terms, data submitted through the API is not used to train Anthropic's AI models. However, Anthropic may retain API inputs and outputs for up to 30 days for trust and safety purposes, including abuse monitoring and legal compliance.
• AI Output Is Not Professional Advice: All output from AI Features is generated by artificial intelligence and is provided for informational and educational purposes only. AI-generated content may contain errors, inaccuracies, omissions, outdated information, hallucinations, or fabricated facts. AI output does not constitute legal advice, medical advice, financial advice, career counseling, claims advocacy, or any other form of professional advice. You must independently verify all AI-generated information before relying on it.
• No Guarantee of Accuracy or Outcomes: We make no warranty or representation that AI-generated resume reviews will result in job interviews or employment; that AI-generated cover letters are suitable for any specific employer or position; that AI claim analysis will result in a favorable VA determination; that AI-suggested job listings are current, available, or accurate; or that any AI-generated advice or guidance is correct, complete, or appropriate for your specific circumstances.
• PROHIBITED SUBMISSIONS — DO NOT SUBMIT PERSONALLY IDENTIFYING OR SENSITIVE INFORMATION: You must NOT submit any of the following to any AI Feature: Social Security numbers; DoD ID numbers or military service numbers; financial account numbers, credit card numbers, or banking details; passwords, PINs, or authentication credentials; protected health information (PHI) as defined under HIPAA; classified information of any level (Confidential, Secret, Top Secret, SCI, or SAP); controlled unclassified information (CUI); For Official Use Only (FOUO) information; personally identifiable information (PII) such as full legal name combined with date of birth, address, or government-issued ID numbers; medical records, diagnoses, or treatment details; information about active duty operations, troop movements, or unit readiness; or any other sensitive, confidential, or restricted data. While we employ input sanitization and topic guardrails, we cannot guarantee the confidentiality of data once it is transmitted to third-party AI services. AI inputs are transmitted to Anthropic's servers and may be retained for up to 30 days for trust and safety purposes. Once submitted, data cannot be recalled or deleted on demand.
• USER SOLE RESPONSIBILITY & ACCOUNTABILITY: YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR ALL CONTENT YOU SUBMIT TO AI FEATURES AND FOR ALL CONSEQUENCES ARISING FROM SUCH SUBMISSIONS. DD Form 214 Life, its owner(s), operators, officers, directors, employees, agents, contractors, and affiliates (collectively, the "Protected Parties") shall bear no responsibility or liability whatsoever for any information you choose to submit to AI Features, including but not limited to any personally identifiable information, sensitive data, classified information, or other restricted content. If you submit prohibited information in violation of this section, you — and you alone — are responsible for any and all consequences, including but not limited to identity theft, security breaches, unauthorized disclosure, violation of federal or state privacy laws (including HIPAA, the Privacy Act, and OPSEC regulations), and any resulting damages, penalties, or legal liability. You agree to indemnify, defend, and hold harmless the Protected Parties from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising from or related to your submission of prohibited or sensitive information to AI Features.
• Topic Restrictions & Guardrails: AI Features are restricted to military-to-civilian transition topics. The AI is programmed to decline requests outside this scope. Any attempt to circumvent these restrictions, including prompt injection, jailbreaking, or social engineering of the AI system, constitutes a violation of these Terms and may result in immediate termination of your account without refund.
• AI Output Ownership: You retain ownership of the text you submit to AI Features. Subject to Anthropic's terms, you may use AI-generated output for your personal, non-commercial purposes (e.g., submitting a generated cover letter with a job application). However, AI-generated output may not be unique to you — similar inputs from different users may produce similar outputs. We make no claim of exclusivity or originality of AI-generated content, and you assume all responsibility for how you use such output.
• Service Availability: AI Features depend on the availability of third-party services (Anthropic's API). We do not guarantee uninterrupted access to AI Features. AI Features may be temporarily unavailable due to API outages, maintenance, rate limiting, or changes to third-party services beyond our control. Such unavailability shall not entitle you to any refund, credit, or compensation.
• Changes to AI Providers: We reserve the right to change, replace, or discontinue any third-party AI service provider at any time without prior notice. This includes changing the underlying AI model, provider, or technology used to power AI Features. Such changes do not constitute a material change to the subscription service.

The AI Job Search feature queries third-party job listing services, including the USAJobs API (operated by the U.S. Office of Personnel Management), third-party job aggregators, and other external employment data sources. By using this feature, you acknowledge and agree:

• Job Listings Are Third-Party Content: Job listings displayed through the AI Job Search are sourced from external services and employers. DD Form 214 Life does not create, verify, endorse, or guarantee the accuracy, authenticity, or availability of any job listing. Listings may be expired, filled, inaccurate, fraudulent, or otherwise misleading.
• No Employment Guarantee: Use of the AI Job Search does not guarantee employment, interviews, or any response from employers. We are not an employment agency, staffing firm, or recruiter. We do not participate in the hiring process and have no control over employer decisions.
• Salary & Clearance Information: Salary ranges, security clearance requirements, and other job details are provided by third-party sources and may not reflect actual compensation or requirements. Always verify job details directly with the employer.
• Government Data Disclaimer: USAJobs data is provided by the U.S. Government and is subject to USAJobs' own terms of use. DD Form 214 Life is not affiliated with or endorsed by OPM, USAJobs, or any federal agency. Government job listings are subject to change without notice.
• Exercise Caution: Never pay money to apply for a job. Never provide your Social Security number, bank account details, or other sensitive personal information to an unverified employer. Report suspected fraudulent job listings to the FTC.

DD Form 214 Life offers paid subscription plans ("Pro," "Pro+," "Mission Ready," and "Command") that provide access to AI-powered features subject to usage limits. By subscribing, you agree to the following:

• Payment Processing: All payments are processed by Stripe, Inc. Your payment information is collected, stored, and processed by Stripe in accordance with Stripe's Terms of Service and Stripe's Privacy Policy. We do not store your credit card number or payment card data on our servers.
• Recurring Billing: If you select a recurring subscription (monthly or annual), your payment method will be automatically charged at the beginning of each billing period at the then-current rate until you cancel. You authorize this recurring charge by subscribing. Price changes will be communicated via email at least 30 days before they take effect.
• One-Time Purchases: One-time (non-recurring) purchases provide access for the stated period (one month or one year) from the date of purchase. Access expires automatically at the end of the period with no automatic renewal.
• Usage Limits: Each subscription tier includes specific monthly and daily usage limits for AI Features as described on our Pricing page. Usage limits reset on the 1st of each calendar month (monthly) and at midnight Eastern Time (daily). Unused usage does not roll over. We reserve the right to modify usage limits with 30 days' notice.
• Cancellation: You may cancel your recurring subscription at any time through the Stripe Customer Portal or by contacting us. Upon cancellation, you will retain access to paid features through the end of your current billing period. No partial refunds will be issued for the remaining time in a billing period.
• Refund Policy: Recurring subscriptions: No refunds for partial billing periods. One-time purchases: Full refund available within 7 days of purchase if you have used fewer than 5 total AI Feature requests. After 7 days or 5 uses, no refund is available. To request a refund, contact legal@ddform214life.com.
• Account Termination: We reserve the right to suspend or terminate your account and subscription at any time, with or without cause, including but not limited to violation of these Terms, abuse of AI Features, attempted prompt injection or jailbreaking, exceeding rate limits through automated means, or fraudulent payment activity. In the event of termination for cause, no refund will be issued.
• Service Modifications: We reserve the right to modify, suspend, or discontinue any subscription plan or AI Feature at any time. If we discontinue a plan you are currently subscribed to, we will provide at least 30 days' notice and either migrate you to an equivalent plan or provide a prorated refund for the unused portion of your billing period.

The Site may contain links to third-party websites, resources, and services, including government agencies (such as VA.gov), veteran service organizations, employers, educational institutions, and other external resources. These links are provided solely for your convenience and informational purposes.

The inclusion of any link does not imply endorsement, approval, or recommendation by DD Form 214 Life. We do not control, endorse, or assume any responsibility for the content, accuracy, privacy policies, practices, or views of any third-party websites or resources. Accessing external links and relying on third-party content is entirely at your own risk. We strongly encourage you to review the terms of service and privacy policies of any third-party websites before using them.

The Site may display advertisements provided by third-party advertising networks, including Google AdSense, as well as direct sponsor placements. These advertisements may be targeted based on cookies or other tracking technologies as described in our Privacy Policy.

The appearance of advertisements on the Site does not constitute an endorsement, guarantee, or recommendation of any advertised product, service, or company by DD Form 214 Life. We are not responsible for the accuracy, legality, or content of advertisements or the products and services they promote. Any transactions between you and advertisers are solely between you and the advertiser, and DD Form 214 Life shall not be liable for any loss or damage arising from such transactions.

All Content on the Site, including text, graphics, logos, icons, images, software, code, tools, and the overall design and layout, is the property of DD Form 214 Life or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not, without our prior written permission:

• Copy, reproduce, distribute, publish, display, or create derivative works of any Content.
• Use our trademarks, service marks, logos, or branding in any manner.
• Use automated tools, bots, scrapers, crawlers, or data mining software to access, extract, or index Content from the Site.
• Frame, mirror, or embed any portion of the Site without written authorization.

You are granted a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site for personal, non-commercial purposes in accordance with these Terms. YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS DD FORM 214 LIFE, ITS OWNER(S), OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND AFFILIATES (THE "PROTECTED PARTIES") from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, judgments, settlements, fines, penalties, costs, and expenses (including reasonable attorneys' fees, court costs, and investigation expenses) arising out of or relating to:

• Your use or misuse of the Site, its tools, or AI Features.
• Your violation of these Terms of Service or any applicable law or regulation.
• Any content, data, or information you submit to the Site or AI Features, including but not limited to personally identifiable information, classified information, or other prohibited content.
• Your infringement of any intellectual property or other right of any person or entity.
• Any third-party claim arising from your actions, content, or use of the Site.
• Any criminal, regulatory, or law enforcement investigation, inquiry, or proceeding arising from your conduct on or through the Site.

This indemnification obligation shall survive the termination of your account, your subscription, and these Terms. The Protected Parties reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify the Protected Parties, and you agree to cooperate with such defense.

DD Form 214 Life is a platform provider. We do not control, endorse, or assume responsibility for user-generated content or user conduct. Each user is solely responsible for their own actions, submissions, and compliance with all applicable laws when using the Site and its features.

THE PROTECTED PARTIES SHALL NOT BE LIABLE FOR, AND YOU AGREE TO HOLD HARMLESS THE PROTECTED PARTIES FROM, ANY AND ALL CONSEQUENCES ARISING FROM THE ACTIONS OR CONDUCT OF ANY USER, including but not limited to:

• Submission of false, fraudulent, classified, or illegal content by any user to AI Features or other parts of the Site.
• Any criminal or civil liability arising from a user's misuse of the Site, including unauthorized disclosure of classified information, submission of stolen PII, fraud, or other unlawful activity.
• Any law enforcement investigation, subpoena, search warrant, or legal process directed at the Site or the Protected Parties as a result of any user's conduct.
• Any regulatory or government enforcement action arising from a user's violation of HIPAA, the Privacy Act, ITAR, EAR, or any other federal or state regulation through their use of the Site.

Cooperation with Law Enforcement: DD Form 214 Life will cooperate with law enforcement authorities and comply with valid legal process (including subpoenas, court orders, and search warrants) to the extent required by law. We reserve the right to disclose any information about a user's account or usage that we are legally required or permitted to disclose. We may report suspected illegal activity to appropriate law enforcement agencies at our sole discretion.

Safe Harbor: To the fullest extent permitted by applicable law, DD Form 214 Life and the Protected Parties claim safe harbor protections as a provider of an interactive computer service under Section 230 of the Communications Decency Act (47 U.S.C. § 230) and any similar state or federal laws. We are not the publisher or speaker of any user-generated content or user-submitted AI inputs and outputs.

DD Form 214 Life is an independent, privately owned and operated website.
